Refund and Cancellation Policy

This Refund and Cancellation Policy forms part of the gigit Platform Terms and Conditions and is incorporated into the Agreement by reference. Capitalised terms used in this Policy have the meanings given to them in the Platform Terms and Conditions.
In the event of any conflict between this Policy and the Platform Terms and Conditions, the Platform Terms and Conditions shall prevail in relation to legal authority and consumer rights, and this Policy shall prevail in relation to operational processes and refund amounts.
1. Cancellation by Employer
1.1 Before Booking: If the Employer cancels a Task before assigning it to a gigit hero, no charges will apply.
1.2 After Booking (More than 24 Hours Before Start Time): The Employer will receive a refund of the Task Price only. The Platform Fees are non-refundable, as the Platform's matching and reservation services have been provided.
1.3 After Booking (Less than 24 Hours Before Start Time): gigit reserves the right to deduct a cancellation fee of up to 20% of the Task Price. The remaining balance will be refunded.
1.4 Arrival Cancellation: If the Employer cancels after the gigit hero has arrived at the agreed time and location (as evidenced through the Platform), gigit may apply a charge to reasonably compensate the gigit hero for their time, travel, and lost opportunity. Any remaining balance may be refunded at gigit's discretion.
1.5 Mutual Cancellation: Where both the Employer and the gigit hero agree to cancel a Booking before the Task starts, gigit will refund the Task Price to the Employer. Platform Fees and any costs already incurred may be deducted at gigit's discretion. Mutual cancellation must be agreed and recorded through the Platform.
1.6 Hero Out-of-Pocket Costs: Where a gigit hero has incurred documented, non-recoverable costs in preparation for a Task that is cancelled by the Employer (such as materials purchased specifically for the Task), gigit may, at its discretion, deduct these costs from any refund to the Employer and pass them to the gigit hero. The gigit hero must provide evidence of the costs and that they cannot reasonably be used for other Tasks.
2. Cancellation by gigit Hero
2.1 Hero Cancellation or No-Show: If the gigit hero cancels the Task or fails to attend, the Employer is entitled to a full refund of the Task Price. Platform Fees are non-refundable in respect of the matching and reservation services provided. gigit may compensate the Employer further at its discretion.
3. Scope Mismatch and Task Changes
3.1 Inaccurate Task Description or Conditions Preventing Performance: If the gigit hero arrives at the agreed time and location and (a) the actual Task requirements are materially different from those described in the Task posting, (b) the Employer is not present or does not provide access, (c) the worksite is unsafe, or (d) the Employer has not provided materials, equipment, or access they agreed to provide, the gigit hero may decline to proceed.
3.2 Mobilization Fee: In such cases, gigit may charge the Employer a reasonable mobilization fee to compensate the gigit hero for time and travel costs. The remaining balance will be refunded.
3.3 Additional Work: Any changes to scope or additional work must be agreed and processed through the Platform.
Users must not arrange, agree to, or process any additional work or payments outside of the Platform. gigit is not responsible for any arrangements made outside the Platform, and such actions may result in account suspension or termination.
3.4 Partial Task Completion: Where a Task is started but not completed in full — whether due to scope mismatch, agreed change of scope, or other circumstances — gigit may determine a proportionate release of the Reserved Payment based on the work performed, evidence provided by both parties, and any non-recoverable costs incurred. Any unreleased balance may be refunded to the Employer.
4. Disputes and Resolution
4.1 Raising a Dispute: If the Employer believes a Task is incomplete or does not meet agreed requirements, they must raise a dispute with gigit within 7 days of the completion notification.
4.2 Evidence Review: Both parties may submit evidence through the Platform. gigit will review all available evidence, including chat logs, photos, and Platform records, and determine an outcome within a reasonable timeframe.
4.3 Cooperation: Both parties agree to cooperate fully with gigit's investigation and to provide requested documentation promptly.
4.4 Platform Authority: gigit will determine whether a full refund, partial refund, partial release to the gigit hero, or no refund is appropriate based on the work performed, the circumstances of the dispute, and the parties' conduct under the Platform Terms and Conditions.
4.5 Appeals: If a party disagrees with gigit's determination, they may contact gigit support with additional evidence. gigit's decision following review is final, subject to rights under applicable Thai consumer law.
5. Escrow and Reserved Payments
5.1 Reserved Payment: Upon Booking confirmation, the Task Price is held as a Reserved Payment by the Payment Service Provider until the Task is completed or the Booking is cancelled in accordance with this Policy.
5.2 When Funds Are Held: Funds remain held while the Task is active, during dispute resolution, or during any investigation by gigit or the Payment Service Provider.
5.3 When Funds May Be Withheld: gigit or the Payment Service Provider may withhold release of funds where fraud, a breach of this Policy, or a dispute is identified.
5.4 Reversal of Released Payments: Where payment has been released in error or following a successful dispute, gigit may reverse or recover the amount in accordance with the Platform Terms and Conditions.
5.5 Disputed Payments: Disputed payments will be handled through the dispute process in Section 4. Funds remain held until a determination is made.
6. Payment Release and Finality
6.1 Payment Release: If no dispute is raised within 7 days of the completion notification, gigit will review the Booking and determine the appropriate release based on available evidence and the parties' conduct.
6.2 Finality of Transactions: Once payment is released, the transaction is considered final and non-refundable, except where required by applicable Thai law or Clause 5.4.
7. Refund Processing
7.1 Refund Method: Refunds are processed to the original payment method where possible.
7.2 Processing Timeframes: Processing times depend on the payment provider and the Employer's bank. gigit does not guarantee specific timelines.
7.3 Payment Processing Fees: Refunds may exclude or be adjusted to account for non-recoverable payment processing fees charged by third-party providers.
7.4 Failed Refunds: If a refund to the original payment method is not possible, gigit may determine an alternative refund method.
8. Off-Platform Transactions
gigit is not responsible for any losses, damages, or disputes arising from Tasks, payments, or agreements made outside of the Platform.
9. Force Majeure
9.1 In the event of circumstances beyond reasonable control (including natural disasters, government action, or public health emergencies), gigit may waive cancellation fees or adjust refund outcomes on a case-by-case basis.
9.2 Where a Task cannot be performed due to a force majeure event affecting either party, gigit will generally refund the Task Price to the Employer, minus any Platform Fees and non-recoverable costs already incurred.
9.3 Where a Task is partially completed before a force majeure event, Clause 3.4 applies.
10. Consumer Rights
Nothing in this Policy excludes, restricts, or modifies any right or remedy available to an Employer who qualifies as a consumer under the Consumer Protection Act B.E. 2522 or any other mandatory provision of applicable Thai law. Where applicable Thai law requires gigit to provide a refund or remedy that this Policy would otherwise not provide, gigit will comply with that legal obligation.
11. General
11.1 All refunds and cancellations are subject to review and final determination by gigit.
11.2 gigit reserves the right to modify this Policy at any time. Changes will be notified to Users via in-app notification on the Platform and will take effect no earlier than 14 days after notification. Continued use of the Platform following the effective date of the updated Policy constitutes acceptance of the revised Policy.
